Terms & Conditions

Terminology:

Prime Time Messenger Inc. will hereinafter be referred to as "PTM".

Acceptance:

By placing an order with PTM for a pick-up and/or delivery, you hereby agree to all the terms and conditions stated herein.

Rate Proposals:

Are subject to acceptance within 30 days, activated proposals are subject to review after 90 days and the rates may be adjusted if volumes vary substantially from information given. Rates are subject to renewal one (1) year from date of acceptance (unless otherwise specified in writing), continued application of rates is conditional on account being in good standing at all times.

Payment:

Invoices are payable upon receipt. Any discounts to an order are subject to payment being received on time. Late payments shall be subject to a charge equal to a monthly rate of interest of 1.5% on the total balance outstanding. The shipper agrees to pay PTM all shipping charges in the event of non-payment by the consignee or the alternative party billed.

Proper Packaging/Labeling:

Each article must be properly packaged and include the receiver's address, and be documented on a PTM waybill.

Fragile Goods:

Shall in all cases be sent "at the shippers risk" (e.g. glass), unless adequate insurance is purchased in writing.

Right Of Inspection/Refusal:

PTM reserves the right to open and inspect any package tendered to it for transportation, and refuse to carry any that are prohibited and, in our judgment, could otherwise cause damage or delay to equipment, personnel or other shipments, including those prohibited by law.

Re-Weigh:

PTM reserves the right to reweigh shipments, notwithstanding that a weight has been declared on the shipping document, and adjusts weights accordingly.

Additional Charges:

Please refer to the agreed upon rate guides in effect at the time of shipping for specific rates for any/all additional charges that may apply (all rates subject to change without notice).

Delay:

Unless agreed otherwise in writing, PTM is not financially responsible for the consequences of failure to deliver a shipment by stipulated time.

Applicable Law:

The contract for the carriage of goods as contained in the PTM waybill shall be deemed to include and be subject to the terms and conditions as prescribed by the law of the jurisdiction where the goods originate.

Indemnity:

You hereby release, and agree to indemnify and hold harmless PTM and its subsidiary corporations and their respective officers, directors, employees and agents from any and all claims, demands, causes of actions, liabilities, damages, costs and expenses, including reasonable attorney's fees, arising out of Your use of viewing of PTM and its Content

BY THE CONDITIONS SET OUT BELOW, PTM AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS ARE FIRSTLY NOT TO BE LIABLE AT ALL FOR CERTAIN LOSSES AND DAMAGE, AND SECONDLY, WHEREVER THEY ARE TO BE LIABLE, THE AMOUNT OF LIABILITY IS STRICTLY LIMITED TO $50.00.

Claims:

If you wish to claim for a lost (includes undelivered) or damaged shipment. You must state your claim in writing and we must receive your claim within 30 days from the date that we accepted your shipment.

Insurance:

PTM provides no automatic coverage against loss of damage of a shipment. If the shipper wishes to purchase such coverage, the value must be declared in writing on the PTM waybill, and an additional premium will be assessed. The additional premium is calculated at 3% per $100.00. Where no amount is declared, the amount of loss that PTM will be liable shall not exceed $50.00

Shipper's Warranties:

You hereby warrant that: All information provided to PTM orally, or set forth in the air waybill or in any other documents completes by you or by us at your request, is accurate and complete; and Each article in the shipment is properly described on the waybill and has not been declared by us to be unacceptable for transport; and Any value ascribed by you to a shipment is correct; and the shipment is properly marked and addressed and packed to ensure safe transportation with ordinary care in handling; andAll applicable customs, import, and other laws and regulations, of all countries to, from, through, or over which the shipment may pass, have been complied with. You agree to indemnify and hold us harmless for any claim, liability or expense arising from your failure to comply with any applicable laws or regulations.

Lien:

You agree that PTM should have a lien on any goods shipped for all freight charges, customs duties, advances or other charges of any kind arising out of or in connection with transportation of shipments and may refuse to surrender possession of the goods, and refuse to deal with any claim, until such charges are paid.

Deliveries:

Shipments cannot be delivered to PO Boxes or postal codes. Shipment is delivered to the receiver's address given by you but not necessarily to the named receiver personally. Shipments to addresses with a central receiving area will be delivered to that area.

Fuel Surcharge:

All deliveries are subject to a fuel surcharge which will fluctuate based on existing political and economical circumstances.
